Right to Erasure Request Form

Altheris Capital OÜ, doing business as Kortex Trading, is a private limited company registered in Estonia, Registry Number 14745896 (“Altheris” or “Company”). The registered address of Altheris is Karja 27a, Haapsalu, 90502, Läänemaa, Estonia.

Consistent with data privacy and protection laws and regulations that apply in the European Union (“EU”) and the Republic of Estonia, a member state of the EU, Altheris is providing you with this Right to Erasure Request Form (“Form”) which you may complete and submit to Altheris if you choose to exercise your right to request Altheris to erase your personal information that Altheris has collected and stored.

Within one (1) month of receipt of this form, Altheris will erase your personal information it has stored to the fullest extent permitted by applicable law or request additional information from you if needed to process your request.

The information you provide in this form will only be used for the purpose of complying with your request. You are not required to use this form to submit your request, but by using this form, it is easier for Altheris to process your request.

Section 2 – Information Needed If You Are the Data Subject

To process your request, we need proof of your identity and address. You must provide scanned or photocopied copies of one or both of the documents for each section described below (do not send originals):

Proof of Identity: Passport, Driver’s License (with photo), National Identity or Residency Card (with photo), or Birth Certificate.
Proof of Address: Utility Bill, Bank Statement, or Credit Card Statement. The document must not be older than three (3) months and must have your address. A driver’s license with your photo and your address may also provide proof of your address.

This website does not accept document uploads. Once this form is submitted, send these documents by email to compliance@altheriscapital.com, quoting the name and email address entered above.

Section 4 – Reason for Submitting the Request to Erase

Due to the sensitive and irreversible nature of erasing personal data and information, Article 17(1) of the GDPR requires that certain conditions must be met before a request can be considered. Please select the reason you want Altheris to erase your personal information. If necessary, please attach any documents supporting your reason to this submission.

You believe your personal information is no longer necessary for the reasons Altheris collected it. You no longer consent to Altheris processing your personal information. You object to Altheris processing your personal information as is your right under Article 21 of the GDPR. You believe your personal information has been unlawfully processed. You believe that Altheris is required under the laws of the EU or an EU member state to erase your personal information. You are a child, you were a child, or you represent a child at the time of the data processing and you believe your personal information was used to offer you Information Society Services as defined in Article 4(25) of the GDPR.

Section 5 – Information You Want Altheris to Erase Please describe the information you want Altheris to erase. Include all relevant details, including any URL links if possible, that will help Altheris identify the data you want erased. Please explain why any linked webpage is about you or the person you represent.

Article 17(3) prohibits Altheris from erasing information under certain circumstances. These circumstances include erasure if erasure would: adversely affect freedom of expression; contradict a legal obligation; act against the public interest in the area of public health; against the public interest in the area of historical or scientific research; or prohibit the establishment of a legal defense or the exercise of other legal claims. You will be notified if one of these circumstances applies to your request.

Article 12(5) of the GDPR allows Altheris to charge a fee or refuse to honor a request if it is determined to be “manifestly unfounded or excessive.” Altheris will attempt to honor your request to the best of its capabilities but reserves the right to exercise its rights under Article 12(5) and will notify you accordingly. Altheris’ refusal does not prohibit you from modifying your request.
